Terms of use

These terms apply to your access to and use of Brisbane Unlocked at https://brisbaneunlocked.com.au(the "Site"). By using the Site, you agree to these terms. If you do not agree, do not use the Site.

1. The service

Brisbane Unlocked provides an online directory and discovery experience for events, experiences, venues, markets, and related local content in Greater Brisbane and surrounding areas. Listings may be curated, moderated, edited, or removed at our discretion. We do not guarantee uninterrupted or error-free operation.

2. Eligibility and acceptable use

You agree that you will not:

• Use the Site in breach of law or third-party rights;
• Upload malware, probe or attack our systems, or scrape the Site in a way that degrades performance or bypasses reasonable access controls;
• Misrepresent your identity or affiliation, or submit false or misleading listings;
• Harass, defame, or threaten others, or post unlawful, hateful, or sexually exploitative content;
• Collect personal information from other users without lawful basis and consent.

3. Listings and user content

When you submit a listing or other content ("User Content"), you represent that you have the rights to provide it and that it is accurate to the best of your knowledge. You retain ownership of your User Content, but you grant us a non-exclusive, worldwide, royalty-free licence to host, reproduce, adapt, publish, display, and distribute User Content for the purpose of operating, promoting, and improving the Site and related channels (including social media and email), unless we agree otherwise in writing.

We may moderate, edit for clarity or style, refuse, or remove User Content at any time. Submission does not guarantee publication. Commercial listings may be subject to additional criteria communicated at submission or on the Site.

4. Intellectual property

Except for User Content and third-party materials, the Site design, branding, text, graphics, and software are owned by us or our licensors and protected by intellectual property laws. You may not copy, modify, or create derivative works from those materials without our prior written consent, except for temporary copies strictly needed to browse the Site or as allowed by law.

5. Third parties and links

The Site may link to third-party websites, ticketing platforms, or social profiles. We are not responsible for third-party content, terms, or privacy practices. Your dealings with third parties are solely between you and them.

6. Disclaimers

The Site and all content are provided on an "as is" and "as available" basis. To the maximum extent permitted by law, we disclaim all warranties (express or implied), including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that listings are complete, current, or suitable for any purpose. You rely on listings and event information at your own risk and should confirm details with organisers or venues before attending or purchasing.

7. Limitation of liability

To the maximum extent permitted by law, we (and our directors, staff, and suppliers) are not liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or goodwill, arising from your use of the Site or User Content. Where liability cannot be excluded, our total liability for any claim arising out of these terms or the Site is limited to the greater of AUD $100 or the amounts you have paid us in the twelve months before the claim (if any).

Nothing in these terms excludes, restricts, or modifies any consumer guarantee, right, or remedy under the Australian Consumer Law or other legislation that cannot lawfully be excluded.

8. Indemnity

You agree to indemnify and hold harmless Brisbane Unlocked and its affiliates from claims, losses, liabilities, and expenses (including reasonable legal fees) arising from your User Content, your breach of these terms, or your misuse of the Site, except to the extent caused by our gross negligence or wilful misconduct.

9. Suspension and termination

We may suspend or terminate access to the Site or remove listings at any time, with or without notice, including for breach of these terms or operational reasons.

10. Changes

We may change these terms by posting an updated version on the Site. The "Last updated" date will change accordingly. Your continued use after changes constitutes acceptance of the revised terms, where permitted by law.

11. Governing law

These terms are governed by the laws of Queensland, Australia. You submit to the non-exclusive jurisdiction of the courts of Queensland and the Federal Court of Australia sitting in Queensland.
